Before you create, keep the service boundary clear.

1. Agreement

By downloading, accessing, or using Awaking, you agree to these Terms of Service. Awaking is distributed through the Apple App Store. Unless a separate custom EULA is provided, use of the app is also subject to Apple’s Standard Licensed Application End User License Agreement.

2. App functionality

Awaking provides local creative tools for photo import, filters, presets, color, composition, masks, effects, layer management, photo comparison, Smart Stitching, project organization, and export. Specific features, compatible devices, and system requirements depend on the current App Store version.

3. User content and rights

You retain the rights you lawfully hold in the photos you use and the work you create. You are responsible for having the rights and permissions required to edit, save, share, or delete the relevant content. Awaking does not acquire ownership merely by processing a photo locally.

4. Free features

Without an Awaking account, you can import photos, use essential editing tools, undo and redo, and export a watermark-free standard JPEG. Free capabilities remain subject to device performance, system permissions, asset availability, and current-version compatibility.

5. Awaking Pro

Awaking Pro unlocks selected Pro filters, presets, mask templates, and effects, plus High-Quality PNG, batch export, replace-original export, and unlimited Aesthetic Duels. Pro does not mean that every current or future feature is automatically included. The entitlement shown in the app and verified by Apple at purchase defines access.

6. Subscriptions, auto-renewal, and introductory offer

Awaking Pro offers monthly and yearly auto-renewable subscriptions. Apple charges your Apple Account when the purchase is confirmed. Unless canceled at least 24 hours before the current period ends, the subscription renews automatically, and Apple charges the renewal within 24 hours before the end of that period.

You can view, switch, or cancel subscriptions in your Apple Account subscription settings. Apple’s purchase confirmation sheet controls the final price, currency, and billing period.

This release does not offer a free trial. Eligible first-time subscribers may see an introductory offer on the monthly subscription only. Apple determines eligibility and displays the offer price and duration before purchase.

7. Lifetime unlock

Awaking Pro Lifetime is a non-consumable in-app purchase that provides ongoing access to the local features covered by the current Awaking Pro entitlement and ordinary maintenance updates. It does not automatically include future separately priced cloud AI, external compute, account sync, or other independent services.

Purchasing Lifetime does not automatically cancel an existing subscription. If both Lifetime access and a subscription are present, review the subscription’s auto-renewal status in your Apple Account.

8. Restore Purchases and refunds

Awaking provides Restore Purchases through Apple StoreKit for eligible purchases. Apple handles purchases, billing, taxes, and refunds. Use Apple’s official process to request a refund.

9. Acceptable use

You may not use Awaking to violate applicable law, infringe intellectual-property, privacy, publicity, or other rights, create or distribute illegal, harmful, fraudulent, or misleading content, or reverse engineer, copy, resell, or redistribute the app except where permitted by law and Apple’s license terms.

10. Privacy and local processing

The core photo analysis, editing, and export in the current release run on device. Read the Awaking Privacy Policy for the boundaries around Photos permissions, iCloud originals, support bundles, support email, website hosting, and StoreKit.

11. Service changes and availability

We may fix errors, adjust the interface or features, change how free and Pro capabilities are organized, or discontinue support that is no longer practical. We will not misrepresent an already purchased entitlement as unpurchased, but we do not promise that every feature will remain identical across all devices, photos, system versions, or future releases.

12. No warranty

To the maximum extent permitted by applicable law, Awaking is provided “as is” and “as available.” We do not guarantee that every edit, rating, stitch, AI-assisted process, export, or compatibility path will meet every expectation. Aesthetic ratings are for entertainment and creative reference only and are not professional assessments.

13. Limitation of liability

To the maximum extent permitted by applicable law, Awaking and its provider are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the app. Nothing here limits rights that cannot be limited under applicable consumer-protection law.

14. Updates to these terms

We may update these terms when features, purchase options, or legal requirements change. Material changes will be presented in an appropriate place and consent obtained where required. A new effective date will appear at the top of this page.
